Ryanair says 'no basis' for latest Air Berlin complaint

(XFN-ASIA) - Ryanair Holdings PLC. said there is no basis for the latest appeal by Air Berlin PLC. against Ryanair's cost base at Hamburg Luebeck Airport.

 

A report in Leipziger Volkszeitung, citing an Air Berlin spokesman, said Air Berlin had filed a complaint against Luebeck airport with the German Federal Court of Justice, claiming the airport granted special conditions to rival Ryanair. The German Association of Airlines sees the test case as a possible precedent for future cases related to airports subsidizing carriers, the newspaper said.
 

The European Commission last year launched formal state aid investigations into several airports including the one in Luebeck for signing bilateral contracts offering airlines lower airport charges than those proposed by published airport charge regulation. 

Luebeck airport concluded a bilateral contract with Ryanair in 2000 that the Commission at the time said may constitute illegal and incompatible state aid. Ryanair said Luebeck is a privately owned airport, which is free to enter into negotiations with Ryanair and any other airline. It said Air Berlin was offered a similar cost base to Ryanair at Hamburg Lk but refused to take up this offer.
